چکیده

از مهمترین مباحث مربوط به خانواده و جامعه اسلامی، حقوق غیر مالی زوجه و اعطاء آن است. در این میان، اعطاء حقوق غیر مالی زوجه از این جهت که زوجه رکن اصیل را در خانواده ایفا می‌نماید، ضرورتی غیر قابل انکار داشته و موجبات تعاملات احسن در روابط زوجین را فراهم می‌آورد. پژوهش حاضر با رویکردی کیفی و بر پایه اسناد و مدارک فقهی، حقوقی و جامعه شناختی به شکل بنیادین مورد بررسی قرار گرفت. در عرصه مفهوم حقوق غیر مالی زوجه مهمترین مصادیق آن مبتنی بر حق مساکنه، معاشرت به معروف و .... قابل توجه است و در تعاملات بین زوجین در موازنه تعادل می‌توان به تعامل ناشی از رفتارهای مترتب بر پیمان زوجیت دست یافت. مهمترین نتایج رضایتمندی زوجه در ترتب احیای حق غیر مالی او، تقلیل تعارضات بین عملکرد اجتماعی زن و احتفاظ خانواده، تعمیق سازگاری‌های مبتنی بر اقناع نیازهای روحی زن و از مسائل مهم و تأثیرگذار در رضایت روحی حاصل از زناشویی آن است که اعمال صحیح حقوق استمتاع، تمکین یا مواقعه در آن تاثیرات بسزایی خواهد داشت. چراکه توفیق زوج‌های شادکام در شناخت و ادراک درست و دقیق یکدیگر در این حیطه، مقدمات لازم را برای زندگی مناسب و صریح و تبادل پیام، شیوه‌های مناسبی برای درک یکدیگر فراهم می سازد است.

Introduction: One of the most important issues related to the family and Islamic society One of the most important topics related to the family and Islamic society is the wife's non-financial rights and their granting. In the meantime, granting non-financial rights to the wife has an undeniable necessity because the wife plays the main role in the family and provides the means for better interactions in the couple's relationship.



Methods: The current research was fundamentally investigated with a qualitative approach based on jurisprudential, legal, and sociological documents.



Results: The findings indicate that in the field of the concept of non-financial rights of the wife, the most important examples are based on the right of residence, socializing with others, etc. A marriage contract was reached. The most important effects of it (such as: satisfaction of the wife in order to restore the husband's non-financial rights, reducing the conflicts between the social performance of the woman and maintaining the family, deepening the adaptations based on the persuasion of the spiritual needs of the woman, etc.) One of the most important and influential issues in the spiritual satisfaction of marriage is that the correct application of the rights of enjoyment, compliance or situations will have significant effects. Because the success of happy couples in knowing and understanding each other correctly and accurately in this area provides the necessary preparations for a proper and frank life and exchange of messages, suitable ways to understand each other.
